Terms of Use

1. Acceptance of Terms

By downloading, installing, or using the Petal application ("App") or visiting petalhealth.app ("Website"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App or Website. Petal is operated by Hawthorn LLC ("we," "us," or "our").

2. Eligibility

You must be at least 13 years old to use Petal. If you are under 18, you may use the App with parental consent. Certain features (such as intimacy tracking and partner notifications) are automatically restricted for users under 18.

3. Account Registration

To use Petal, you must create an account with a valid email address. You are responsible for maintaining the security of your account credentials. You agree to provide accurate information and to update it as necessary.

4. Subscriptions & Payments

Petal offers free trial access and paid subscription plans. Subscriptions are processed through Stripe, a third-party payment processor. By subscribing, you authorize recurring charges at the rate and frequency described at the time of purchase. You may cancel your subscription at any time through the Manage Subscription link in Settings. Cancellation takes effect at the end of the current billing period. Refund requests are handled on a case-by-case basis within 30 days of purchase.

5. Not Medical Advice

Petal is a wellness and tracking tool, not a medical device. The information provided by the App — including cycle predictions, pregnancy insights, and educational content — is for informational purposes only and does not constitute medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider for medical decisions. Do not rely on Petal as a method of contraception.

6. Your Data

You retain ownership of all health data you input into Petal. You may export your data at any time (Settings → Export Data) and delete your account and all associated data at any time (Settings → Delete Account). Our handling of your data is governed by our Privacy Policy.

7. Apple Health Integration

Petal may request read-only access to Apple Health data (workouts and weight). This integration is optional and can be disabled at any time. Apple Health data is used solely to display wellness trends within the App and is handled in accordance with Apple's HealthKit guidelines.

8. Acceptable Use

You agree not to: (a) use the App for any unlawful purpose; (b) attempt to gain unauthorized access to our systems; (c) reverse-engineer, decompile, or disassemble the App; (d) share your account credentials with others; or (e) use automated means to access the App except as expressly permitted.

9. Intellectual Property

The App, including its design, code, content, and branding, is owned by Hawthorn LLC and protected by copyright and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

10. Limitation of Liability

To the maximum extent permitted by law, Hawthorn LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim. The App is provided "as is" without warranties of any kind, express or implied.

11. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time. Upon termination, your right to use the App ceases and your data will be deleted in accordance with our Privacy Policy.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the App or by email. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of Oklahoma, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Payne County, Oklahoma.
